BioMarin Pharmaceutical Inc., a pioneer in rare disease biotechnology, is inviting applications for the position of Associate Director, Corporate Counsel, Product and Commercial. Based in San Rafael, California, this is a full-time, mid-senior level in-house legal role. The successful candidate will join a dedicated legal team supporting BioMarin's global operations and its revolutionary portfolio of therapies for genetically defined conditions.

Key Responsibilities

The Associate Director, Corporate Counsel will be responsible for providing strategic legal counsel and commercial support. Key duties include:

  • Regulatory & Compliance Counseling: Advise internal stakeholders on advertising, promotional activities, external communications, and sales/marketing initiatives in compliance with FDA and OIG guidance, as well as industry codes (e.g., PhRMA).
  • Committee Representation: Serve as the primary Legal reviewer across Medical, Legal, and Regulatory (MLR) committees for assigned products and disease states.
  • Contract Management: Independently draft, review, and negotiate complex commercial contracts to support BioMarin’s global commercial organization.
  • Risk Mitigation: Provide guidance on potential legal issues and risk mitigation strategies concerning product liability, anti-trust, the Anti-Kickback Statute, and the False Claims Act.
  • Compliance Collaboration: Partner with the Global Compliance & Ethics Program to conduct risk assessments, assist with investigations, and design corrective action plans.

Eligibility Criteria

Candidates must meet the following professional and academic requirements:

  • Education: A Juris Doctor (JD) degree from an accredited law school and an active bar license in good standing.
  • Experience: 3 to 7 years of relevant legal experience. This experience should ideally be gained within a law firm, a regulatory agency, or an in-house pharmaceutical/healthcare legal department.
  • Specialized Knowledge: Proven familiarity with the AdPromo framework, MLR review processes, OIG Guidance, Federal Sentencing Guidelines, and healthcare fraud and abuse laws.
  • Skills: Exceptional drafting, negotiation, communication, and project management skills, with a demonstrated ability to operate in complex regulatory environments.
